Employer Compliance and Employee Protection: Understanding EPF and SOCSO Responsibilities

CCIFM, BeluxCham Malaysia and the Malaysian Dutch Business Council jointly hosted an EPF & SOCSO session on compliance and employer obligations.

CCI France Malaysia jointly organised the EPF & SOCSO information session with BeluxCham Malaysia and the Malaysian Dutch Business Council; bringing together employers and HR professionals for a practical and informative briefing on statutory contributions and social protection in Malaysia.

 

The first session focused on the Employees Provident Fund (EPF) and the Non-Malaysian Mandatory Contribution Eligibility (NMCE). The session provided clarity on employer responsibilities when hiring non-Malaysian employees, including the steps required to register employees manually via the KWSP Employer i-Akaun and preparations for the Thumbprint Capture (CIJ) process. Participants also gained a clearer understanding of how to avoid administrative delays, penalties, and issues related to EPF withdrawals.

 

Key topics included the registration process for non-Malaysian employees, applicable work permits subject to mandatory contributions, and the nomination process under NMCE. The session further addressed practical scenarios such as the “Leaving the Country” withdrawal process, tax relief on voluntary excess contributions, the point at which contribution liability ends, and the transfer of accounts to Unclaimed Monies after three years of inactivity.

 

The second session, led by Ms. Farah Wahidah Anuar, focused on SOCSO (PERKESO) and the protection and benefits available to both employers and employees. The briefing aimed to strengthen awareness of employer obligations under the SOCSO Acts while highlighting the scope of social security coverage in Malaysia.

 

Participants were guided through the key legislative frameworks, including the Employees’ Social Security Act 1969 (Act 4 – Lindung Pekerja), the Employment Insurance System Act 2017 (Act 800 – Lindung Kerjaya), the Self-Employment Social Security Act 2017 (Act 789 – Lindung Kendiri), and the Housewives’ Social Security Scheme (Lindung Kasih). Together, the sessions offered valuable insights to help organisations remain compliant while ensuring adequate protection for their workforce.
